Many people and organizations do not support vaccine mandates. The Constitutional Alliance is one such organization. The Constitutional Alliance believes the decision to be vaccinated should be made by the individual, and if the individual chooses, after consultation with their doctor(s).
The case law requiring or mandating vaccinations and/or mask wearing is not as clear as some would have others believe.
"A requirement that someone be vaccinated imposes a greater burden on personal liberty than, say, having to attend church virtually as opposed to in person. However, as the Supreme Court stated in 1941, “The right to practice religion freely does not include liberty to expose the community … to communicable disease.” Justice Antonin Scalia, speaking for the court nearly 50 years later, came to a similar conclusion that laws advancing civic obligations such as compulsory vaccination may override claims of religious freedom."
What does not make sense is how individual people or organizations can oppose vaccine passports but not see the similarities with the Real ID Act 2005.
Let's take a minute and compare a vaccine passport with what a Real ID compliant drivers' license is required for and could be required for going forward.
We know that a vaccine passport essentially has one purpose - to control the unvaccinated persons access to places. It is to prevent an unvaccinated person from entering a particular building, place, city, state, or country Possession of a vaccine passport shows others that a person has been vaccinated.
A vaccine passport would most likely have a person's name, country of origin, date of vaccination(s), some type of numbering system, and a digital facial image on the passport. If a vaccine passport is simply a paper document showing the person's name, where they were vaccinated, and when they were vaccinated, the paper document could be easily counterfeited easily rendering it useless.
The Constitutional Alliance is aware that today in the United States paper documents/cards are being given to those that have been vaccinated. If a decision is made to move to a more permanent vaccine passport using the justification of pandemic control, or that there will be more pandemics going forward, it is likely that paper passports will not be used. Again, the Constitutional Alliance unequivocally opposes vaccine passports.
A vaccine passport could be a laminated document such as a drivers' license, or a digital document that would be downloaded on a smart phone in much the same way that drivers' licenses are being downloaded on smart phones using an app provided by a state/commonwealth agency or department that oversees the issuance of drivers' licenses.
Today, there are already countries and even some US cities that are utilizing vaccines passports. Because one reason for using vaccine passports would be to travel from one country to another, international standards for vaccine passports are being developed. The WHO (World Health Organization) is already proposing a digital interoperable vaccine passport with international standards required. There is already discussion about combining a vaccine passport with an identification document such as drivers' licenses or passports. We do not believe the result would be one digital document but rather several digital documents that would be referred to as a digital wallet. As new viruses appear your digital passport would need to be updated. Also, if current vaccines wear off, boosters would be needed which would result in your digital vaccine passport needing to be updated. People should be aware that if digital vaccine passports become mandatory the result would mean a hospital, healthcare provider, or other such entity would need to either have access to your smart phone to update you digital vaccine passport, or require you to download an update to an existing app already on your phone. There is little doubt this would make your smart phone more susceptible to malware.

The Constitutional Alliance has been steadfast in supporting the right of people to make choices of their own about what devices they will or will not use. We vehemently oppose requiring people to use smart phones. An individual must have a choice about whether they want to download a government application/app.
The Constitutional Alliance has spoken with many cyber experts about the security of digital applications. To a person, the consensus has been that nobody can assure you a downloaded app is secure whether the app comes from the government or corporations. We have spoken with former intelligence officials of the NSA, CIA, and FBI. Consider the following:
"But even when digital ID is used with good intent, risks of two sorts must be addressed. First, digital ID is inherently exposed to risks already present in other digital technologies with large-scale population-level usage. Indeed, the connectivity and information sharing that create the value of digital ID also contribute to potential dangers. Whether it is data breaches and cyber-intrusions, failure of technical systems, or concerns over the control and misuse of personal data, policy makers around the world today are grappling with a host of potential new dangers related to the digital ecosystem.
Second, some risks associated with conventional ID programs also pertain in some measure to digital ID. They include human execution error, unauthorized credential use, and the exclusion of individuals. In addition, some risks associated with conventional IDs may manifest in new ways as individuals newly use digital interfaces."

Let's return to our original question: How can a person oppose vaccine passports but not the Real ID Act 2005, and the need for Real ID compliant drivers' licenses? All digital facial images/photographs that are needed today for the purpose of complying with a federal law or international requirement such as traveling from one country to another, incorporate ISO (International Organization of Standardization) standards for the capture, retention, and sharing of the digital facial image, a biometric.
Take a step back for a minute and think about the fact that vaccine passports and Real ID compliant drivers' licenses both are used to allow an individual access to a building or place, whether that place be a city, state, or country. Many people are not aware of what an EDL (Enhanced Drivers' License) is. An EDL is Real ID compliant and is used to travel to other countries in the Western Hemisphere. The DHS (Department of Homeland Security) has published new rules saying Real ID complaint drivers' licenses will be required in 2023 to travel domestically on a commercial airliner in the United States.

Keep in mind that a digital vaccine passport does not tell anyone if an individual who has been vaccinated is a victim of a breakthrough virus. Breakthrough viruses are by definition viruses that are contracted by people who have been vaccinated. Tens of thousands, if not more of these breakthrough viruses have been documented. There seems to be no question that people who have been vaccinated are not as likely to need to be hospitalized in an ICU (Intensive Care Unit) or die. The Constitutional Alliance believes that vaccination must still be an individual's choice to make because of religious reasons or other considerations such as preexisting medical conditions.
Businesses have the right to refuse service to people who have not been vaccinated or people who refuse to wear a mask. The "free market" will decide if businesses that have these requirements are hurt or prosper by having these requirements in place. The Constitutional Alliance firmly believes we each need to respect the choice that others make. Ridiculing people who have not been vaccinated or those that have is not productive. Physically destroying a business because it does or does not require people to be vaccinated and/or wear masks is not helpful either. Law enforcement already has a tough enough job without having to deal with people over vaccination or mask requirements.
Just as the Constitutional Alliance has proposed a solution to make sure a person is who they say they are and does not have more than one drivers' license in their name or any other name, we have a solution to stopping vaccine mandates.
Take a minuscule percentage of the amount of money spent on vaccines and develop an accurate rapid test for finding out if a person has contracted the virus. The public is told that people who have contracted the Delta variant of the Coronavirus have a very large virus load in their nostrils. We have no reason to doubt this assertion about the virus load. If the virus load is so large, how is it the scientists cannot develop an accurate rapid test to find out if a person has contracted the virus? If you have influenza, the flu, a doctor can give you a test and tell you in minutes if in fact you have the flu. There is a Texas company that has already developed an accurate virus test. The test has a turnaround time of 18 hours. It is not clear if the 18 hours is a result of a shortage of manpower or other reasons. The Constitutional Alliance will be speaking to experts to find out just how feasible is it that a rapid test can be developed that would produce accurate results in minutes instead of hours. We will let you know what we find out.
The Constitutional Alliance does have an obligation to inform people that there is an incubation period for the Coronavirus regardless of the variant. It can take several days after a person is exposed to the virus and actually contracts the virus before test results would come up positive for the test. This simply means if you are going to visit someone after getting off a plane or being in a situation where you are in contact with many people, you may want to wait several days and get tested before seeing the person you want to visit.

Unlike a Vaccine Passport, the purposes for a Real ID compliant drivers' license are unlimited.
The Secretary of the DHS (Department of Homeland Security) alone under the law, the Real ID Act 2005, can decide for what purposes an individual can be required to show a Real ID compliant drivers' license. We know a Real ID compliant drivers' license is needed to enter certain federal buildings/certain national parks, nuclear facilities, and to be able to fly domestically on a commercial airliner. The fourth official purpose of the Real ID Act 2005 states that the Secretary of DHS can add Official Purposes at his or her discretion without the need for congressional approval. The Secretary can decide to add purchasing a firearm or ammunition or sending money to family overseas as Official Purposes. Former Secretary of DHS, Michael Chertoff put it this way:
“Homeland Security Secretary Michael Chertoff encourages the use of the REAL ID system for a wide variety of purposes unrelated to the law that authorized the system. In an opinion column written by Secretary Chertoff after the publication of the final rule in January (2008), he said, “embracing REAL ID” would mean it would be used to “cash a check, hire a baby sitter, board a plane or engage in countless other activities.” http://epic.org/privacy/id_cards/epic_realid_0508.pdf (page four)
So again, we ask, how can a person object to a COVID Passport and not the Real ID Act 2005?
There is something else that a COVID Passport and Real ID have in common. Both have better solutions than spending billions and billions of dollars. Real ID has already cost between $10 and $20 billion. This does not include the millions and millions of dollars states/commonwealths are spending each year to stay in compliance with the Real ID Act.
Despite the Real ID Act law (Public Law109-13) requiring that birth certificates be verified so that counterfeit drivers' licenses or the birth certificates of deceased people cannot be used to vote or acquire a drivers' license, This crucially important verification is not taking place.
Not one state can say they are verifying all the birth certificates or other primary forms of identification that provides a person's name, date of birth, place of birth of all drivers' license applicants, or of people who register to vote and/or vote. There is a system set up to verify birth certificates that needs only about $10 million to be completed, and about one year for the robust software programming to be put in place.
The Constitutional Alliance has provided the solution along with the evidence our government knows the solution does exist. Why isn't our federal government or states implementing the solution? It is because our government wants your biometrics. Your biometrics are the linchpin of a surveillance state. The Constitutional Alliance believes we have answered the question, how can those that who oppose a vaccine mandate do not oppose the Real ID Act 2005? There is no justification for opposing one and not the other. Both vaccine mandates and the Real ID Act 2005 must be opposed.
