THE REAL ID ACT 2005 – OFFICIAL PURPOSES AND YOUR BIOMETRICS

The Constitutional Alliance has written over 100 articles about the Real ID Act 2005 since the law was enacted 17 years ago.

Eye Opener !

Recently the Constitutional Alliance was asked to comment again on the Official Purpose(s) of the Real ID Act 2005, how the 2nd Amendment can be infringed upon, biometrics, and verifying birth certificates. We are adding a comment of our own because people ask where in the Real ID Act is DHS allowed to get information from the sellers of firearms and/or ammunition.

Firearms sellers are already required to keep their records for seven years.

By mandating all firearms sellers to have the purchaser provide a Real ID compliant drivers' license, then the collection of the information by the federal government of who purchased a firearm or ammunition is just a matter of Rulemaking.

By including all firearms sellers (for example: private firearms sales or sales at gun shows), the Director of DHS can massage their Rulemaking to be as narrow or broad as they choose. 

The point is that Congress does not need to sign off on the Secretary of DHS requiring a Real ID compliant drivers' license of all purchasers of firearms and/or ammunition. The Real ID Act 2005 gave the Secretary  of DHS that authority without any requirement of peer review or Congressional oversight.
